At Telly, we take your privacy seriously. Please read this Viewing and Activity Data Policy Supplement to learn how we treat your viewing and other activities on your Device and through the use of our Services. We collectively refer to the Device and Services as the “Telly Product” or “Product”. 

Remember that your use of the Product is at all times subject to our Telly Product Terms of Service at [www.telly.com/product-terms-of-service], which incorporates the Telly Product Privacy Policy [www.telly.com/product-privacy-policy]. Any undefined terms in this Policy have the definitions given to them in the Telly Product Terms of Service or the Telly Product Privacy Policy.

Telly provides a free internet-connected television (your or the “Device”), and Services that power its experience.  This Supplement provides additional details about the privacy practices related to your Viewing Data and Activity Data when you use the Product.

Viewing Data

We may collect information about the audio content you listen to, video content you watch,  channels you view, the duration of your viewing sessions, apps you use, games you play, and the ads that are served to you while doing any of the foregoing. This data is referred to as “Viewing Data.” Viewing Data is associated with the IP address for your Device and a unique device number we assign. Telly will combine and associate your Viewing Data with your Telly account when you create such an account or link to it to provide you with a more personalized experience on your TV.

The Viewing Data software also periodically collects other information about the TV or display, including IP address and the media access control (“MAC”) addresses of available access points. Viewing Data is maintained, used and shared in an unidentified format, and we do not, and we prohibit our authorized data partners from attempting to re-identify the data to associate it with individual customers.

Viewing Data may be used by Telly and authorized data partners (1) to prepare analytics and reports for Telly’s partners, including advertising agencies, programmatic partners, audience measurement companies, data partners, surveying partners, and others (2) for audience measurement, (3) to provide recommendations and customized content, including advertisements to you, and (4) to improve the overall Telly offering and experience.  

We also may disclose Viewing Data to select data partners for the purpose of targeting advertising to other digital devices that share the IP address of a Device, based on viewing history collected from that Device. If we do so, Viewing Data will be shared in an unidentified format, and authorized data partners will be prohibited from attempting to re-identify the data to associate with individual customers.

Activity Data

We also collect information about how you interact with the Device, such as your search queries, preferences, applications you open, purchases or other transactions you make, the time of your sessions, the frequency of your sessions, duration of your sessions, and other usage data. The Device also includes a sensor that helps us detect motion and presence near the Device (described below).  This data is referred to as “Activity Data.” Activity Data is associated with the unique device number we assign to your Device and may be associated with the IP address of your Device.

Tellys includes a low-powered sensor device similar to what a smart home thermostat uses to know when you walk by. These sensors detect motion and presence by approximating the number of moving things near the Device. This is used to enhance the user experience by powering the Device on/off when it senses if something is moving nearby while also making it more energy efficient. The output from the sensor does not identify individuals.

Activity Data may be used by us and our authorized data partners (1) to prepare analytics and reports for Telly’s partners, including advertising agencies, programmatic partners, audience measurement companies, data partners, surveying partners, and others, (2) for audience measurement, (3) to provide recommendations and customized content, including advertisements to you, and (4) to improve the overall Telly offering and experience.

Recommendations and Customized Content

We may share your Viewing and Activity Data with third-party data partners and advertisers, such as our advertising Partners and analytics Partners, who use it to show you relevant ads and provide you with customized content.  These third-party data partners and advertisers are obligated to use this information only for the purpose of delivering advertising that is likely to be relevant to you.  If we do so, Viewing and Activity Data will be shared in an unidentified format, and advertising partners and analytics partners will be prohibited from attempting to re-identify the data to associate with individual customers.

Exercising Your Rights

You have the right to opt-out of sharing your Viewing and Activity Data. You acknowledge that exercising such right will terminate your rights to the Product, including use of the Services and will require you to return your Device).
