Notice of Financial Incentive

If you are a California resident, you have the right to receive this Notice of Financial Incentive pursuant to the California Consumer Privacy Act of 2018, Civil Code §1798.100 et seq. This notice provides you with information regarding the personal information we collect from you when you use your Telly Device and the related Services (together, with the Telly Device, the “Product”) and your rights over such information.  Any undefined terms in this Notice of Financial Incentive have the definitions given to them in the Product Terms of Service.

Personal Information Subject to this Notice of Financial Incentive

At Telly, we value your data because it enables us to improve our Product, better serve you, and to provide you the ultimate free television upgrade for the living room. When you use the Product you consent to receiving the Telly Device, a free internet-connected television, and the Services that power the Product (the “Financial Incentive”) in exchange for the right to use the personal information you provide to Telly. The Financial Incentive we offer you is reasonably related to the value of any personal information you provide to us. We estimate the value of your personal information by considering, without limitation, the value of the Product, the expenses we incur to provide the Financial Incentive to you, the revenue and/or value to Telly generated by your taking advantage of the Financial Incentive, and any improvements we can make to our Products based on information obtained through the Financial Incentive. 

During your participation in the Financial Incentive, we may collect, use, and share your personal information as described in our Website, App and Pre-order Privacy Policy [www.telly.com/reservation-privacy-policy] and Product Privacy Policy [www.telly.com/product-privacy-policy]. Specifically, we may collect or enable the transmission of following categories of personal information about you:

  • Profile or Contact Data
  • Payment Data
  • Commercial Data
  • Device/IP Data
  • Internet Service Data
  • Device Analytics Data 
  • Photos, Images, Videos, and Voice Command Data. For clarity:
  1. If you choose to use applications that leverage Telly’s built-in camera (such as Zoom for video conferencing or motion-tracking fitness applications), Telly will transmit your video or images to service providers that you authorize. The Telly camera is equipped with a built-in privacy cover that will be closed by default as an extra layer of control for you. Applications that use the camera on the Telly do not store images or videos from your usage sessions on the device and simply route to the applications you are using in accordance with their policies.
  2. Your Telly Product detects when you’ve activated its voice command and query functionality by saying the “wake” word. After activation, it can respond to voice commands and queries. Audio streams and transcripts are not retained or stored by Telly.

  • Inferences Drawn from Personal Data Collected
  • Other Identifying Information that You Voluntarily Choose to Provide
  • Any other personal information you may enter into a free-form field of our surveys or forms.

In addition to the categories listed above, we also collect Viewing Data and Activity Data as discussed in our Viewing and Activity Data Policy Supplement [www.telly.com/viewing-activity-data-policy].

Your Rights When You Participate in the Financial Incentive 

If you are a California resident, you will be required to consent to this Financial Incentive program when you confirm your Telly Device order. You may withdraw your consent at any time. If you would like to withdraw from this Financial Incentive program, or otherwise exercise your rights under the CCPA, you may email us at any time at support@telly.com.  Please note that an opt-out from this Financial Incentive program will terminate your rights to the Product offered under the Financial Incentive, including use of the Services and will require you to return your Telly Device. Additionally, while you have certain rights related to the personal information we hold about you, including the right to delete your personal information (as further described in our Website, App and Pre-order Privacy Policy [www.telly.com/reservation-privacy-policy] and our Product Privacy Policy [www.telly.com/product-privacy-policy], exercising such rights, which are subject to certain exceptions, may not be compatible with your participation in this Financial Incentive program and will interfere with your use of your Telly and related Services (i.e., the Product).
